BGP advises qiibee regarding Token Sale

11. January 2018

Bader Gnehm & Partner advises qiibee, a Crypto Valley based Swiss start-up, regarding its Token Sale (also referred to as ICO or Initial Coin Offering).

qiibee (www.qiibee.com) is developing a decentralized, blockchain-based loyalty ecosystem, by providing a platform and developer interface with which every loyalty application can be tokenized.

In order to ensure full compliance with anti-money laundering regulations during the Token Sale, qiibee has - as one of the first ICO-projects in Switzerland - registered itself with the leading and largest officially recognised self-regulatory organisation (SRO) in Switzerland.

Bader Gnehm & Partner advised qiibee with regard to all Swiss legal aspects of this Token Sale. The team was lead by Oliver Gnehm (Partner) and furthermore included Jürg Locher (Partner), Bastian Blank (Associate) and Theresia Klötzli (Jurist).

Arbitration

30. October 2017

BGP successfully conducts international arbitration proceedings for a fish processing company.

BGP successfully represents the interests of Kpone Lobster Export Company Ltd. in international arbitration proceedings.

Kpone is a fish processing company based in Accra (Ghana). Subject of the arbitration proceedings was a claim relating to outstanding purchase price payments. The action was brought against a major European retailer and distributor of fish products based in Spain. Kpone has supplied the respondent with fish products with a total value of approximately EUR 1.9 million.

The parties agreed that all disputes arising out of or in relation to the purchase agreements shall be resolved by an arbitral tribunal constituted in accordance with the Swiss Rules of International Arbitration of the Swiss Chambers’ Arbitration Institution (Swiss Rules). The institutional arbitral tribunal had its seat in Zurich. As the parties did not agree on the applicable law, the arbitral tribunal determined Spanish law as applicable.

The BGP arbitration team was led by Olivier Bula (Senior Assosciate) and included in particular Michael Bader (Senior Partner). With regard to Spanish law, BGP was assisted by Victor Cores Kuijlaars and Silvia Pujol Pamies, both lawyers of cores & garcía pedrerol, abogados, a law firm domiciled in Barcelona. Such as BGP, cores & garcía pedrerol, abogados is also a member of the worldwide lawyers network LAWorld (www.laworld.com).

The Swiss Rules are the international arbitration rules of the Chambers of Commerce and Industry of the cantons of Basel, Berne, Geneva, Neuchâtel, Ticino, Vaud and Zurich. The Swiss Chambers' Arbitration Institution, which was founded in this context, offers services of national and international arbitration and other forms of dispute resolution (www.swissarbitration.org).
